Wanted to let everybody know that we received our green cards in hand today. We immediately made a trip to the Social Security office to update the records and get rid of the clause that says "not valid for work without INS authorization". We also signed a new I-9 with the green card.

Hi Guys I have a couple of questions . Would really appreciate it if you could help.
1) My lawyer for some reason doesn't want to apply EAD for me, though she is ok with applying for EAD card for my wife(dependent). She says I have 1 more year for H1 etc. May be its company policy , I am not sure but What are my options?
2) My salary is about 15% less than the prevailing wage and the amount being mentioned in my offer letter being filed with I-485. Since this is a substantial amount of money, I was wondering is the company legally responsible to honour the offer letter or not?

are they talking about calling from US to any India #? this sounds ridiculous.
What's ridiculous about it? Their website say's that you can call any number in India ( land line or cellular ) for free and unlimited time. It clearly says - * Calls to cellular phones included.

Maybe we can use the H-1 B reform bill, to recapture unused visas during the last many years. Make H-1 B tough but at the same time, release those green card numbers. Carrot and Stick approach.

This is one of the key reasons why we are not successful in our mission. All we can do is "lets kill H1/L1 so I can get GC", "lets not worry about EB3 as long as my EB2 is fine!". The only way we can make any progress is to stay united. Lets not try to find carrots that would really be sticks on people who are also part of this cause.

Hi guys,
How long does it take to receive RFE letter by mail? Can we get a copy of RFE letter at the InfoPass appointment. I don't have patience anymore to wait. At least they can tell us what the RFE is about on the phone. These guys are trying my patience.

Went for first interview on 4th Jan. Got confirmation email today 15th Jan 2008. Got this email about an hour back.

Please drop the following documents off at one of the VFS locations listed below.
1. Yellow pending letter
2. Passport
3. Envelope provided by the consulate (yellow, blue or green color)

Just talked to a recruiter from a software giant.
She specifically wanted to know if I was on EAD and if yes, unfortunately they cannot hire EADs during the fourth quarter (now) due to hiring budget limitations that are typical during the fourth quarter.
Q: Why does budget come in to picture here?
A: Because policy requires the legal dept to be consulted for visa holders and EADs which means additional hiring costs plus time.
But she said once the fourth quarter passes, EAD hiring is not a problem.
Folks, we should not remain quiet about this. The regulations make it illegal for an employer to discriminate based on immigration status. We should politely and respectfully pursue the authorities regarding this matter.
I would encourage you to point out the USDOJ guidelines (posted earlier) to the "software giant" employer and also contact the OSC worker hotline.
Also, would it be wise for people to post name of the company who are known to have such policies? We got one - CapitalOne from earlier posts.

That if eb2 numbers are not filled then they automatically get allocated to eb3 so why to have portability to eb2.

I wanted to put down the various steps I undertook or have happened since my PD got current in hopes that it might help anybody...
PD: Nov 2005 EB2 @ NSC got current in August.
We were in India when my wife got a FP notice in July. Missed it completely but was lucky that the lawyer realized we were on vacation and requested a postponement of FP appointment.
The original FP appointment notice was for July 7th and we never received a second appointment notice until Aug 20th.
In the meanwhileI travelled back to USA and opened SRs, Infopass and sent emails to NSC, Opended an Ombudsman inquiry, contacted senators separately for myself and for my wife. I got GC approval on August 10th.
My wife had her FP taken on Sept 3rd and today we received CPO email for her too. Good luck to all who are waiting and I suggest do everything you can like SRs, emails, contacting senators, ombudsman inquiry, infopass appts. Not sure what worked.
My Main conern was that my AOS (principal applicant) would be stalled because my spouse (dependent) had expired FPs and we missed an appointment. Apparently this turned out not to be the case.
