Yes, my I 140 was approved.Recently my company was audited.So I suspect the USCIS want all the company info before they could give my H1B extension.Infact when they filed for first tiem there was no query and second time extension also was smooth but this time there is a query.

This is a real problem. I got a letter from a prospective employer, who wanted proof that I was legally eligible to work in the US (alongwith transcripts, previous employment letters etc.) prior to scheduling an interview.:cool:
I believe employers are seeing a lot of candidates on EAD, and for whatever reasons they dont think EAD is good enough and would like to weed those candidates out beforehand.
We need to fight back against this discrimination.:mad:

And to make matters worse, this jerk married a Mexican woman. He is alway behind Mexico and Mexicans for some reason. Imagine that, he lives in NJ, has a several acre house, makes 7/8 figure salary and then teaches American middle class a lesson to avoid goods produced in China/Mexico/India. Avoid them because they add up to trade deficit of USA, avoid them because those countries have stolen jobs from middle class Americans. Why doesn't Lou Dobbs stop using software written by some Indian/Chinesse guy? Why doesn't he stop eating at a place where in the kitchen a Mexican guy is making his meal? why doesn't he stop using Japnesse cars? Why doesn't he quit eating Pizza....afterall it is Italian food? Why doesn't he stop driving on interstate highways...part of those were made by African Americans. I am asking Lou Dobbs to show me his grand father's VISA/I-94 when he came to the USA, on a ship, half starved, half naked from some european country and never went back! This guy blames mexicans/legal or immigrations for this country's broken health care system. Other day, he was concerned that in California, especially L.A. and surrounding area, white people's percentage has gone below 50%, Mexicans and Indians are having too many kids, whites are not having enough kids.........this is by far the most racist program CNN runs and we need to do something to put a stop on it.

Looks like this year USCIS understood they need some money and accept some extra applications, which may be the same file I485 when PD is not current. and date might go to end of 2007.

Hi Folks,
In many of the articles and forums I have read that applicants spent a lot of money on medical exams, lawyer fees, and so on towards the Employee based Green Card application.
Is it legal for one to spend money (out of one's own pocket) towards getting employee based green card ?
From what I had hear from my company's legal department was that they cannot take any money from me towards the green card application as it is not legal. Employee Based Green Card is for Employer's benefit and not employee's....though it eventually helps the employee -:)
Any comments ?

Why kill the messenger ?? Yesterday when the possibility of mid month retrogression was brought up every one said it is nonsense. Now every one seems to be accepting and reconciling to the fact that there is a possibility that mid month retrogression might happen.
Give it a day and see as it unfolds. Although I hope this is NOT TRUE , I will not be surprised if this is TRUE. It is better we know about it in advance, how depressing this might be, than caught by surprise.

Amazed at the level of speculation, inspite of the detailed Procedures released by Rajiv Khanna ( and re posted by IV) .
I am one without an EVL, sent after new memo took effect , that has been recipted and finger printed.
So please read the 485 USCIS procedure again, and do not worry about sending endless 485s just because of lack of initial evidence
I doubt that. Medical was relaxed since it can take time for people to get the medicals done. Also immigration doctors were all busy at this time. So it is possible that people arent able to get the meds done by the Aug 17 deadline. The other documents like EVL shouldnt take this long. If the employer is willing to provide future employment to someone then it should be sent along with the application. Whether USCIS will relax for lack of Initial Evidence other than Medical is hard to say. It is always better to be safe than sorry.

Your response would depend on how badly you want this job.
Most times the hiring staff doesn't know the law and are too lazy. Anything out of the ordinary, they just reject.
If you want the job, you don't want to appear like a trouble maker. So, you could just write back politely that you were surprised by the disqualification since the Department of Homeland Security (do not write USCIS) had issued the EAD and enquire if they know that DHS guides employers against discrimination towards EAD holders. You can mention or attach form I-9.
Alternatively if you want to hold their feet to the fire, you can contact a lawyer. Hiring a lawyer should get their attention. Let the lawyer contact them. And also let DHS know about this employer. Write to them.
In any case, we cannot let employers come up with their own laws after we have gone through so much to get to the EAD stage. The law is the law and we are following it.

I am July 2 filer and I called yesterday and they gave me this BAD news. They said "Other reasons". I can't think of what they could be. They said they are sending application back which I did not receive yet.
Any one here unlucky as me unfortunately? Anyone have came across this situation? Your help will be greatly appericiated.
