Well its been three and half weeks and waiting.. I am loosing it now. I dont understand what takes them this long to look at a file and put it into this database?

Hi,
One of my friend is working in L1 on Informatica tool for one of the financial client.
Does it mean that his company is violationg rules?
His company is harrassing much for some personal reason and asking him to come back home country
what action he can take against his company if his company viaolating L1 rules.
Please anyone come across this situation then give us your suggestion.

He can not take any action. If they ask him to go back he has to go back. If informatica is embedded in another s/w which is company copyright then there is no technical violation of L1. Also if the project is administered by his company there is no violation of L1. If it is staff augmentation case, which does not seem to be the case here, then it could be violation of l1.

Did you even go to college? You claim to be higly skilled and educated, I really doubt it!
Do things in this order -
1. Find a job first.
2. Secure a good apartment at new job's location.
3. If you need a better car buy one right now.
4. Get some credit cards.
5. Let your home go to foreclosure.
It is a financial decision. Every once in a while, most of us go to different stores and ask them to match the price for the item that we had purchased earlier. If they do not match the price then we return that item. Don't we? Do not get sentimental. Just walk off! Your credit history would get screwed but if you plan it the way I said above, you will be fine. Good luck.
And it won't affect your GC.

I think the company should be filing the fees but lawyers fee for filing is not their liability.
I am paying for everything including filing fees. I thought that the company is no longer involved once you are through the I-140 stage.

The protest was inspired by the abrupt reversal last week of an announcement issued in June offering expedited processing of green card petitions for thousands of skilled foreign professionals working under H1-B visas.
Thousands of holders of H1-B visas -- reserved for skilled workers in computing, engineering and other special professions -- scrambled and spent money on lawyers and medical exams to prepare green card applications for a July 1 deadline.
The abrupt closure of this path to a green card -- proof of lawful permanent resident status -- sent the applicants back to the queue for 2008, when they will have to spend more time and money, organizers of the protest said.
"The gist of the campaign was to peacefully convey disappointment and concern at how things have evolved in the last month," said Sivakanth Mundru, a Virginia-based computer systems analyst who was affected by the policy.

Krish I believe that Feb - Apr 2007 is very realistic now although we don't have all the details of the news yet. 12K numbers if applied in May will lead to 4-5 months of movement not just a wekl. I do echo VDLRAO's wish there is a good chance that we maybe near the Jul-Aug 2007 line however we should wait for the May bulletin to assess that.

Our priority date is April 2006 and we'd received a RFE in 2009 which we'd responded in June 2009, however, still no update on our case status.
I'd opened a SR, send an email to Nebraska service center and also approached my local senator/congressman, but no update as of yet and just the standard reply.
What to do to expediate? We've been current for more than a month now! :(

For the nth time.. numbers are reduced only after approval and not based on receipt of application. So if you can submit it on July 2nd you submit it on 3rd and so on.
485 Approvals are coming in thousands every day ( as per the increasing activity on pending 485s)...and DOS can any day suspend if they think numbers are over ..so if you are lucky on 2nd you are in and so on ..remember GCs are not only approved in US only it been happening at all the visa posts all the world

Interesting policy. A lot of companies do not sponser H1b and GC because of the woes, costs and hastles associated with it, though they would love to hire the right kind of candidate. But this company is ready to pass the right candidate just because they have to provide a letter?

We dont really know what their real apprehensions are behind not interested in hiring an EAD person..
It could be that
-- They had bad experiences in past with EAD people going out of status due to delays in EAD renewal
-- They have an impression that EAD people or like cats on walls...you never know when they will jump ship !
-- They dont have nor dont want to invest in having some kind of immigration expert in the company to help out employees. And feel (probably mistakenly) that taking on an EAD person, means to have to support him more than merely providing an emp. letter when required.
-- May (mistakenly) be assuming that once the EAD guy gets GC he would have to quit and join the original GC sponsoring company etc
But to simply cover their a88e8 they might put up a facade of "not interested in any kind of sponsoring--including providing proofs of employment etc when needed"

13 years since I landed in this country.....finally, I got the approval email 15 minutes back. I am not sure how to express my feelings (or lack thereof).
I want to thank the following guys from the botton of my heart.
1) KubMilegaGC - who gave me support in September or was around for sometime in October to check on my status
2) SeekerOfPeace, KewlChap and fatjoe - for all the valuable information they have provided. Thank you so much guys!!
I did the following:
1) Took around 10 Infopass appointments, with the last one being today morning at 9 AM PST. IO told me that my case was under review since July 2009.
2) Attorney reached out to AILA liaison
3) Sent DHS-7001 to CIS Ombudsman
4) Letter requesting USCIS secretary Napolatino to inquire about the delay in my case
5) Letter to first lady last weekend requesting to inquire about the delay in my case
6) Several inquiries were made by Congresswoman on my behalf
7) Inquiry was made on my behalf by the senator
8) Opened several SRs - I think around 6 or 7
As a result, I now have around 30 different responses from USCIS/DHS. Looking at each response, it makes me believe that they have not even cared to look at my case and have just pulled out a response from a standard set of responses.
I believe what really helped me is a phone call using the POJ method to TSC. I was fortunate to get a hold of a very nice and polite IO. IO walked me through the entire process and to my utter disbelief told me that my case was still sitting in the storage area and collecting dust (this was 2 weeks back). While I was on the phone, the IO sent a request to the folks in the storage area to pull my file out. Luckily for me, the file was in one of the storage areas in Texas itself. Once the file was at the Texas service center, it sat in the holding area for almost a week . It seems like the officer picked up my file sometime at the end of last week or earlier this morning.
Edit to the post: In hindsight, I think the delay in my case was because I had 4 I-140s (2 from RIR labor and 2 from PERM, one each for EB2 and EB3). I think whenever the IOs looked at my file, they thought that my case was not current. The IO I talked to specifically put in a note for the IO to look at the EB2 140 (June 2004) and not the EB3 I-140 (June 2004) or the I-140s that I have from July 2005. I dont know what to tell my attorney, not sure why they had to file 140s in EB3 for me.
Once again, thanks to everyone who has supported me to get through this painful process. Last 60 days (since September 1st) have been very painful for me.
Good luck to all EB2 who are still waiting and to all the EB3 folks, I hope you guys become current soon and get your GCs - I really really admire your patience.

5) Letter to first lady last weekend requesting to inquire about the delay in my case
6) Several inquiries were made by Congresswoman on my behalf
7) Inquiry was made on my behalf by the senator
8) Opened several SRs - I think around 6 or 7
As a result, I now have around 30 different responses from USCIS/DHS. Looking at each response, it makes me believe that they have not even cared to look at my case and have just pulled out a response from a standard set of responses.
I believe what really helped me is a phone call using the POJ method to TSC. I was fortunate to get a hold of a very nice and polite IO. IO walked me through the entire process and to my utter disbelief told me that my case was still sitting in the storage area and collecting dust (this was 2 weeks back). While I was on the phone, the IO sent a request to the folks in the storage area to pull my file out. Luckily for me, the file was in one of the storage areas in Texas itself. Once the file was at the Texas service center, it sat in the holding area for almost a week . It seems like the officer picked up my file sometime at the end of last week or earlier this morning.
Edit to the post: In hindsight, I think the delay in my case was because I had 4 I-140s (2 from RIR labor and 2 from PERM, one each for EB2 and EB3). I think whenever the IOs looked at my file, they thought that my case was not current. The IO I talked to specifically put in a note for the IO to look at the EB2 140 (June 2004) and not the EB3 I-140 (June 2004) or the I-140s that I have from July 2005. I dont know what to tell my attorney, not sure why they had to file 140s in EB3 for me.
Once again, thanks to everyone who has supported me to get through this painful process. Last 60 days (since September 1st) have been very painful for me.
Good luck to all EB2 who are still waiting and to all the EB3 folks, I hope you guys become current soon and get your GCs - I really really admire your patience.

Nope. Why?
Because pattern shows that LUD on I140 meant transfer of cases to Texas and only few have heard so far from that batch.
