    Whether USCIS can find out or not depends on their IT systems.

    I am 80% sure that you need to be present in US when you are applying for 485. Better safe than sorry. What you can do is - prepare all the documents and file it as soon as step in to this country.

    I think the thread is perfectly valid and we should go for it. If someone has paid income taxes to US for 10 years, it is no mean thing. 10 years represent typcially about 25% of his/her earning life. After spending substantial percentage of one's life living in, and making contributions to, US, especially in his/her youth, the guy is more naturalised except that he does not have a citizenship card. Now how many of these guys will be able to slip back in to their own country to readjust their lives with american born and american grown kids.

    I think it is not only reasonable but also humane for the government to consider the plight of such people and issue citizenship. The yardstick for qualification will have to be worked out, but Saralayar listed some of the valid parameters like
    - 10 years working in US (legally)
    - 40 points in social security
    - no criminal record

    If I may share my thoughts on yardstick, it would be like this
    - 7 years of legal residence, contributions to SSN, and taxes should provide provisional GC
    - 10 years of legal residence, contributions to SSN, and taxes should provide citizenship
    - 7 years of legal residence post approved I-140 should provide citizenship

    Most of us in this forum must have already contributed over 75K-100K to IRS over the years. I strongly believe that the govt owes more than an obligation to take care of the interests of this skilled group.

    That's exactly what I wrote a few posts above. I think the more basic question is - What does 485 inventory mean? Is it already filed 485 numbers or "can be filed based on approved I-140" numbers?

    To the OP: Can you provide the link from where we can open the PDF instead of just throwing the PDF open. Maybe that will provide a better context to the numbers.

    I finally get the chance to share our wonderful news with you all. We (me and my wife) received our "Welcome new resident" e-mails this morning.

    11 yrs for me and 12 yrs for my wife since coming to the USA. Between the two of us, Three J1s and Two F1 stamps, Six H1b stamps, Four 140s, 10 EAD/AP (5 each), 3 finger print notices apiece, Four RFEs between us and a total of $68KUSD in total USCIS fees/Lawyer fees and countless gray hair later and after many an emotional roller coaster over the years, it was our turn today.
    For those of you unclear about the admittedly weird above numbers, take a look at my RD. It is not a typo! I often wondered if I was a lone Dinosaur that survived the meteorite. I never saw anyone with a 4 plus year 485 recently.
    Our 485s were 2 yrs old and approvable when the visa bulletin fiasco happened in summer 2007. Ironically I heard that even my FPs/Background check were cleared by then (which in those days was the main cause of delays).

    I made many approaches over the years to the USCIS via phone, email, and fax, My Congressman contacted them on multiple occasions (atleast 3 times when he forwarded their response to me), and our Senator contacted them once. My lawyer as well as my employer contacted them also. I finally also wrote the ombudsman 2 weeks ago. I was pretty scathing in that letter as well (about their mockery of their stated FIFO policy etc). I am not sure exactly what worked, or if anything at all did, and it was just my time. After a while dealing with the injustice, you just get numb. Today finally I breathe a deep sigh of relief. The loooooong wait is over.

    I've spent so long waiting I even get nostalgic about the early days. I remember very well, blogging one cold December night on Immigrationportal with Wallenpond, Pdakwala, Superman,Khodalmd and many other early IV luminaries in 2005 putting up a rearguard uncoordinated effort, when Rep. Sensenbrenner scuttled our visa recapture chances in conference committee. Following which IV was born with leadership from folks well known to us now. IV is your organisation and platform. It will only be as strong as you let it be.

    I wish each of you all the best of luck and least agony in your wait. Those of you current, have faith, if you are being wronged, Stand up. Write/meet with those in a position to do something. Advocate for yourself. That way, atleast they know, what is going on. Otherwise none can help you.

    I will continue to stick around here and do what I can to help with IVs efforts. I believe with our overall effort, we are helping ourselves yes, but what we are advocating for is correct for this country as well.

    Numbers USA and FAIR painted Sen. Specter and other pro-immigration forces as dark demons who sneaked 8001 and 8002 into budget reconcilation bill. "SNEAKY". "Specter tried to SNEAK immigrants into the budget recon bill".

    Hmm. So sneaking unrelated provisions in bills is wrong. "Its evil" sayeth numbers usa.

    Looks like the sneaking is not un-common. And our own Rev. Frist and Denny Hastert seem to have SNEAKED a relief for drug companies into the Defense appropriations bills.

    I wonder how is that related. Maybe the drug companies make drugs that benefit the US military that needs an appropriations bill and hence the drug-company relieft provisions are tied to Defense appropriations bill.

    Sneaky sneaky sneaky. Mr Tancredo, Smith...how is this for sneaky???HUH?? And numbersusa...what sayeth thou about thy Hastert and thy Reverand Doctor tele-diagnostics Frist??

During this wait for a green card, these immigrants remain trapped in a legal maze, unable to change jobs � even within the same employer � without starting the arduous immigration process over again, and subject to waits that grow longer and longer.

    Lufthansa is another option for no transit visa, cheaper ticket than NW, Emirates or Singapore airlnies, little bit security check at Frankfurt when returning .....

    with emirates, there is a route via dubai (no torture) and one via hamburg + Dubai. I traveled via the second one twice on emergencies. you are ushered in a square box of a building with barbed wires and armed (fully armed and body armored, hand gunned, you-mongrel-looking) guards. There is even a special
    barbed wire line for 'special immigrant' (read asylum or illegal migrants) inside though i have not seen it used. then comes double wammy security checks (show-me-your-baby'smilk-is-edible type). There is one bathroom for each gender that has useless (over 10 months)faucets and one bar (no shop for food). the layover reminded me of concentration camps. But it was still better than $274 ;-)

    So has any discussion started yet?
    OH website also mentioned that there are around 500,000 visa unsed since 1990.

    If HR5882 passes today's debate, where will it go then?

    I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don�t have a valid US visa. (Note: If you have AP, and don�t have a valid visa, you still need a TV).

    I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don�t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).

    Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the �I will kill you right now� look on my wife�s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).

    It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.

    I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don�t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the �good feeling� that you experience during the days leading to your trip.

    I haven�t given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.

    Not been a close tracker all these years, but it all changed at the beginning of October ;)

    But, both my wife and I received CPO e-mails this morning. No welcome e-mails.

    These are some important events in my journey -

    First H1-B - October 2004 (Company X)
    Labor (regular) filed on Jan 20th, 2005 (EB2)
    I-140 filed in August 2006 (Company X)
    I-140 approval in June 2007
    I-485 filed August 2007 (Company X) (EB2, India)
    Second H1-B in October 2007 (Company X)
    Applied for EADs and APs twice since filing our I-485s (Company X)
    Wife and I had a USCIS interview in July 2009 (Company X)
    One LUD immediately after the interview
    No RFEs ever
    Case status showed up as in the "initial review" stage till this morning when the status changed to "Document Production or Oath Ceremony"

    Posting my case, in case someone in similar situation is interested.

    Self : PD July 2002 -EB3
    Spouse : PD Feb 2006 - EB3.

    Suggested by our lawyers.
    File my I-485 with spouse as dependent,
    File my spouse's I-485 with me as dependent mentioning receipt notice of first I-485.
    File for only one set of EAD and AP docs. Doesn't matter with which.

    Filing both in July '07.

    The pitfall to that is with the current rush it could be months before you get the receipt and by that time the spouse's date could have retrogressed.

    USCIS has to work in FIFO process not RIRO(Random In Random Out)... So they can't send Receipt Notice to Aug 17th filer and then look for July 2nd filer. I sent my concern to congressmen? Now choice is your? I can't force you or USCIS for any action but i can do what ever possible by me.. :)

    PS: PD: July 2001 and waiting approx 8 years for GC where my friends are applying for citizenship, if they choose to do so. :)

    Question is that there are so many July 2 filers (including me) who have not got any response yet. Therefore, it is not an isolated case. I don't know if emailing to the Director does any good, as long as USCIS keeps admitting that they have not yet sent all receipts (inspite of weekly bulletins). Until 90 days are over, I guess, USCIS will be unresponsive to individual inquiries.

    Yup, you got it buddy......my point is more from a general perspective than any individual scenarios........and sledge_hammer.....I am well aware of the risk associated with every investment - I do own a house and am paying monthly mortgage installments even when knowing that my investment is at least 100k under water :)......so I perfectly understand the risk that comes with any investment AND i am not blaming my lender for giving me money - as I said before, I could afford it then and I can afford it now!

    I am against this 'nobody saw it coming' and 'too big to fail' business - banks very well knew what was coming and what would it's effect be; they still went ahead and irresponsibly gave out money to people who can't even afford an eat out at Mcdonalds!!!! Nobody should give any bail out to these guys - let them suffer for what they have done; if I am acting responsibly for my deeds (paying monthly installment because I signed up for it) the same should apply to these banks - they should be allowed to fail simply on the fact that they didn't make good business decisions!

    From the punjabi's perspective, it is entirely punjabi's fault. Because he knew what he is getting into when he signed the contract. From the public perspective, the banks were stupid to loan money to everthing that moves and later asking for bailout money from tax payers. I think this is what RDB is trying to say.

    Even USCIS has posted a note on its website. Wake up.
    This campaign was a huge success and still giving dividends.

    I don't know what do you mean by success. as far as media coverage is concerned, Fireign media (India, China or elsewhere) doesn't help. It's local media, which can create some usefull awareness. How does awareness in a different country helps?? I don't know why even people talking coverage about foreig media?????

    Sometime back.. I also read some comment talking about involving Indian govt. in this.... Bullshit.. What does a different country's govt has to do with it!!!

    Point is.. don't get too excited for having done nothing... Do something substantial and keep doing.
