* The news of potential revision of the July Visa Bulletin is understandably taken very hard by everyone including this reporter. After spending sleepless evenings and weekends, this reporter feels like being hit by lightening rod from sky. But people should keep their emotion under control for a number of reasons: First, the AILA reports that they are working hard to stop the State Department from doing this. No one knows how much it will work, but no one knows whether they will change their mind either. Just calm down. Secondly, even if it is released, we have no idea which categories and how much there will be a retrogression. Some categories may turn out to be not too bad. We will just have to wait and see. Thirdly, the AILF is seeking a legal remedy should this rumor indeed materialize. This lawsuit threat may or may not affect the State Department one way or another. We are all educated people and should have received a proper training to maintain a decent composure and not to lose morality and reveal weakness of the personality. Losing one or two days will not induce the sky failling down. Availability of July 485 filing is at this juncture depends on two factors: One is whether the July Bulletin will indeed be revised and the numbers will be retrogressed. The other is whether the USCIS and the visa posts around the world will be able to adjudicate all the backlog I-485 or immigrant visa applications in a very short period of time. Until the Visa Bulletin revision news popped up, the only factor that would control the issue of how soon one should send in their I-485 applications was the speed of USCIS backlog 485 application adjudications during the next two weeks or beyond. Now, quite unexpectedly, our July 485 filing opportunities have been further mystified by not one but two yet-to-be-known factors - Visa Bulletin Revision and USCIS Backlog I-485 Processing Speed. As we reported earlier, we started receiving increasing number of backlog I-485 application approvals in the mail, but we do not know how fast it is undertaken by the USCIS at this time.
* All of us have consumed ourselves for a couple of weeks this month by the CIR. The emotional distress have been futher exacerbated by the I-140 pps suspension decision. By now, we come close to the level of being exhausted. We should go home, take a deep breath, and enjoy family. Shutting this website will not give a peace to the wanderers. Have a nice weekend.

I don't intent to sound rude, but why would this make your life "Suck", "no social life" , "no carreer life", "no nothing life".
Iam in the same position as everybody else, and am deeply dissapointed with the news (hence Iam here), but I just spend 2 hours in a nice pub, drinking nice micro brews, came home had a nice talk with my wife (H4), we are planning on going out for dinner and maybe watch Knocked up afterwords (heard its nice).
If this were to be true, it would delay our GC by another 2-3 years, but we are in this country on our own free will, making good money. Be dissapointed, but this is not the end of the world..Mantain the perspective...
To quote it in a much broader sense, America is not the end of the world - period! Just take it easy and enjoy life...don't freak out if the visa bulletin updates and you don't get to file your 485...we are all in this country by our free will..if we feel the rules of the land are not fair to us..each one of us is free to leave....
On another front, if this actually does happen, I will be the first person to sue USCIS for all the expenses, lost time and headaches that I incurred in preparing the 485 application...I think USCIS can't get away without reimbursing everyone for all of the above...

Ok...the way I see this is 5000min/month at $25 (not adding taxes) is 5 cents a minutes...that is more than what I pay for my calling cards....bottom line....if your monthly calling bill is less than $ 25 there is no reason why you should get Vonage.

You considered the I+ C allocations and subtracted those in line 1. You again subtracted those in your final calculation.
The straight forward calculation is EB2 ROW is entitled to 34,436 (1) and they used 27,406 (2). So splillover was around 7 K.

particularly if demand for immigrant visas increases substantially. Visa numbers can retrogress in the middle of a month and become unavailable without any prior notice. In essence what the memo seems to state is that I can have another employer file an I-140 petition, and if approved, simply substitute the I-140 in my existing I-485.
Is that right?

It is possible to use your new approved 140(EB2). Your date are current and do request USCIS and go in front of GC line. Good luck.

Aren’t intra company transfers supposed to work primarily in sponsor company locations?
I heard they can serve and visit clients, but can they be based primarily in client’s location ?

I am pretty new to the forum (as a member), I have been browsing the same for quite some time and found it a good source of information regarding immigration related activities. Right now I am getting removed from my project as one of the top 3 Indian outsourcing firm is dumping their L1 resources at my client site and replacing all the citizens, GCs, EADs, H1 etc. These resources are used in projects managed and controlled by my client (most of them are consulting assignments) and these resources are used on java/.net/oracle projects, these two are violations of L1 visa restrictions set by USCIS, I want to know how and where to complain against this violation and we have all evidence to prove the same (project documents, time sheets, work assignments etc). Please let me know exactly and to which agencies we should complain.

I have news for you (and the certitude with which you make your claims here are laughable). Computer science graduation rates in US went up this year by 6-8%, because the visa caps since 2003 remained at 65000 instead of 195000 creating some demand here. I personally know kids who wanted to go to Computer science, but went for other areas like health care because of the lack of offshoring/H1 etc. If the crooked Indian offshorers and fly-by-night operators are not driving down the wages, more americans will go to computer science, as they would go for a career as MD or Pharmacist or lawyer (almost all those careers need at least 6-8 years of college). They also know that professional associations like AMA or APhA wouldn't allow importing foreign workers by corporations/hospitals on a scale that H1-bs are imported in IT area
Based on my experience, I wouldn't say that Indian kids have any special skills in maths or science compared to americans. Contrary to what you claim, people are aware of H1s and offshoring(may be so much on the exploitation of L1) as they talk to friends and family and guidance counselors at school. Most of the IT jobs were Indian H1-bs are employed doesn't even need computer science or engineering degree. Some of the best architects I have seen in IT didn't have a computer science major. A green-horn from TCS/INFY with a computer science degree and pretending to be an architect doesn't mean he is the best IT professional available in the market.
American college kids spend most of their time partying and sex. They do not study. Only a very very few really study. Others just get by because professors are under pressure to pass them. If professors fail them, then no student will take their course or give bad rating that will affect their Tenure track. The education system is just pathetic and thus kids prefer to study arts and commerce. It is because they cannot fathom tough calculus or trigonometry. The pre-college years are spent in Prom nights and losing virginity. Thus these people fail to compete at global level. Only very few are good and they go to good universities. On the other hand international students come after lot of hard work and tough competitive education system. They are well trained to learn even in meagre resources and compete with others. This is the reason international students and immigrants do well in this country and innovate.
So stop calling your American people as best and brightest. Most of you who come here on this site and live on anti-immigrant sites are middle aged people who cannot get a job anywhere. You guys are just too lazy to study new technologies that is ever changing. You are more interested in having beers and watching football. Go and study and upgrade yourself rather than whining. You will not be able to convince us however much you try here.

So thats just somebody's interpretation of letter campaign. Perhaps one of the enthusiasts over here should post something over there differentiating the goals of the letter campaign from illegal immigration along with all the arguments posted here and explain that their interpretation is incorrect.

Got CPO email this afternoon. I did not get any other emails (like welcome or decision emails) before this email. Is that normal to send the CPO email before sending the decision notice email?
