NEED HELP!!! what are my options?
I485 denied on Oct 24th 2008. I did not get the letter and realized only when I checked on the USCIS website. My attorney also did not get the letter of denial or even the NOID.
I changed jobs in June 2006 by invoking AC21 (Priority Date - Oct 2002, I140 and I485 filed concurrently, I140 approved in Feb 2005).
The fact is that on all forums there is talk about revocation by previous employer. However please note that approved I140 could either be revoked or substituted. While those AC21 memos talk about revoked I140, the law is not clear when previous employer substitutes the approved I140. I know the substitution process is no longer legal since June 2007, however, it has been abused in the past. My questions to forum members:
1. Is any one in similar situation?
2. I have H1B only until June 2009, Can I work until then assuming MTR is resolved in 2 months (per some optimistic posts on IV)
3. if my employer were to file a PERM labor application--can I port my previous priority date?

We are hearing from multiple sources that, on Monday or Tuesday of next week, State Department plans to issue a revised Visa Bulletin for July 2007. This revised Bulletin would retrogress some or all of the employment-based categories, very likely to the point of unavailable. Reports from AILA members about unusual levels and types of activities by USCIS indicate a particular push to adjudicate employment-based adjustments currently in the pipeline so as to exhaust visa numbers for fiscal year 2007.
This follows the actions of USCIS in June, when it began rejecting EB-3 "Other Worker" adjustment applications even though the Visa Bulletin showed an October 2001 cut-off date, on the basis that the "Other Worker" numbers for the year had been exhausted:mad: :mad: :mad: :mad:

* Prohibit the blatantly discriminatory practice of "H-1B only" ads and prohibit employers from hiring additional H-1B and L-1 guest-workers if more than 50 percent of their employees are H-1B and L-1 visa holders.
We should support, as it puts end to consulting companies abuse.
I dont beleive this people are supporting this idea. This will put an end to H1B hiring by small tech startups.
There are better ways to avoid fraud, eg. by depending on paystubs etc...

that's is how my attorney sent it to me. I just looked at my record copy and answering such questions like this.
By the way fellow IVans, don't forget to keep one copy of every thing (of course NOT the sealed cover)of AOS, EAD, AP filing for your records and future reference. Friday evn. after 3.00 PM is a good time at your office copier. Don't use - Automatic Document feeder (whatever thay call it - you pile your papers on top and press button); do it the hard way. One paper after another.
Don't comeback and CRY that you Original Approval Notice or I-94 or BC or something like that was stuck in the copier and now damaged.
In the section 11 of the document what should be the text incase you are supporting your spouse and child @100%

H1 renewal and change of employer
H1 approved in March 2007
Service center: WAC
Visa appointment on Feb 11 at mumbai
Documents submitted to VFS on Jan 28
On feb 11 I went to consulate and it was a long wait.. overall it took 3 hours to finish everything. When I went inside they handed over my application to me and I noticed that "Not in" was written on my DS156 form on top right corner box. here is the communication with IO
IO: so you are working for xyz company.
me: yes
IO: what are you doing for them
me: explained my role and skills
IO: are you working inhouse or at client place
me: gave client name and details
IO: till which date you are going to work for this client
me: gave details
IO: everything looks fine in your case but similar to what I have told everyone else due to the new system we need to verify your data and it will take about a week for that. (and then he wrote PIMS on my form)
me: I have a return ticket on so and so date...... can I expect before that.
IO: your case is pending only for the online verification unlike other administrative processing so it should take about a week so you should be fine.
he then gave passport back with some envelop and also one yellow paper by selecting following option in that paper
"when administrative processing is completed on your case, you will be contacted and requested to submit your passport, this letter and the accompanying envelope to the nearest VFS office."
though he selected this option, he specifically wrote PIMS on my form.
Note that PIMS problem was there for lot of cases on that day as he explicitly told me that he had to do this for lot of cases.

I am in the same boat. My employer decided to file my case under EB3. For that, even the job position was in such a way that required only EB3. I had 7 years experience at that time. So it could have been EB2. That is fine, I am not sad about it.
My question is, since the original position had requirements that met EB3 and not EB2, how can you now justify moving to EB2 within the same company and for the same position?
You can't move to EB2 if both employer and position remain the same. I was promoted after working with them for 3 years!:rolleyes: Plus I have a Masters in Computer Science. My new position required more experience and a Master's Degree, hence qualified for an EB2.
Similarly, you can change employers and look for a better job. Then you can use the experience gained at the previous employer. But, ALWAYS, the job requirement has to state the need for years of experience or Advanced degree.

Lost in all this is the fact that Punjabi wants to sell his house not because he cannot afford it anymore, but because he wants to move to a different city to a higher paying job and can't be bothered to take responsibility for his failed real estate venture. He could have done the ethical thing and stayed in his present job and paid off his loan but he is choosing not to. And who does he blame for his situation? The concept of the "American dream". So the fact that he wants to shirk his responsibilities in favor of foisting his own debt onto the rest of the country isn't his own fault, it's the "American Dream" that's making him do this. It's not exigent financial circumstances that are causing him to foreclose, it is greed and shortsightedness (colloquially known as "The American Dream"). Greed and shortsightedness already caused him to go 20K under the water. And they will now make him screw up his own credit history. If someone cannot learn from one mistake, I say let him keep making mistakes. He will soon find out how difficult life in the US can be if you don't have a good credit history. As for the burden on us taxpayers, hey, we've been spending 10 billion a week for the past 5 years dropping bombs on people, what's a mere 20K?

Actually I thought they will not accept flowers. But for courtesy and humanity touch they are forwarding. Because of these atleast flowers have some purpose without wastage. This campaign will not have any impact on functioning of USCIS as they are following law. These mistakes are common in every Government organisations and time time mistakes are being corrected. Even congressional hearing happens and finds mistake they will prevent future mistakes like this. It is unlikely for affected persons to get relief immediately. But Many persons will get relief automatically on oct 2007 when DOS sets Cutoff date. I expect cut off date for EB3 2003 or 2004 and for EB2 2005.
I just felt that they did something that most people would not understand. I think the mess today is the result of a series of missteps they took. They not only mismanaged the whole green card thing but also mismanaged the public relations. Hopefully, they have learned from all these dramas. :cool:

I got the CPO email first. In another days 6 days got welcome mail. Then the status changed back to post decision activity. 5 days from there, I got the cards. Even today the status says the same.
Looks like you are so much addicted to check USCIS case update, you still checking your status after you receive your cards :)

Yes, it is for a job which does NOT require security clearance.
Is there a formal way / method to let the company and USCIS know of such discrimination ? Any published guidelines from USCIS ?
My wife works for TCS and is on vacation .We tried contacting the local office here .Though the guy mentioned that they have projects ,he still wants her to goto India and comeback on TCS visa and sent her a email that TCS policy doesntnot allow EAD holders.

How can the current position (EB3) relevant when the new employer is filing your GC for a future job (Eb2) ?
Does the employee need to get promoted in the current job to apply for a future EB2 job ?
Good Question. AC21 usage introduces a "Chicken Or Egg" situation. Our limitations 1) Till we interfile we have to show us fulfilling EB3 job calssification related obligations ( that also is a "future" postion in reality). Now if EB2 application is from "same employer" then that employer can logically produce the letter matching EB2 level experience after "real and natural skill progression" only to prove that you are fit for more advanced skill level job in other words after wait for 2-3 years.
