i heard from my lawyer that we shoud combine them...will talk to him again on Friday...lets see wat he suggests...
does anybody know the process of combining or withdrawing one set....
withdrawing is just a matter of sending them a letter and including your receipt number, asking for that application to be withdrawn.
I am worried about withdrawing because (they have been known to do silly things) of the risk that they withdraw BOTH petitions. We both have somewhat recent PDs, and wont get a chance to file again for YEARS! Might as well let them find out and ask what-to-do. My lawyer is simply waiting for the RFE!
There is also a chance that they dont even bring up the issue of the second application and the first one gets approved in due course of time...

Plaintiff suggests that the fact that her application
has been pending for nearly three years is patently
unreasonable. She argues that Congress intended
applications to be adjudicated within 180 days. See 8
U.S.C. 1571(b) ("It is the sense of Congress that the
processing of an immigration benefit application should
be completed not later than 180 days after the initial
filing of the application . . .."). That [*10] 180-day
timetable may provide some guidance here, although the
"sense of Congress" expressed in INA Section 1571(b)
does not necessarily carry the force of law. See Yang v.
California Dep't of Social Servs., 183 F.3d 953, 958-59
(9th Cir. 1999).
Defendants argue that there is no statutory deadline
by which applications must be adjudicated and that, in
any event, the "first-in, first-out" protocol must be given
deference. True, Congress has not established a
mandatory timeframe for the USCIS to adjudicate
applications. Moreover, "'[t]he passage of time alone is
rarely enough to justify a court's intervention in the
administrative process, especially since administrative
efficiency is not a subject particularly suited to judicial
evaluation.'" Yu, 36 F. Supp.2d at 934 (quoting Singh v.
Ilchert, 784 F. Supp. 759, 764-65 (N.D. Cal. 1992)).
However, the court also recognizes that there is no
precise formula for determining whether there has been
an unreasonable delay. Instead, "[w]hat constitutes an
unreasonable delay in the context of immigration
applications depends to a great extent on the facts of the
particular case." Id.

You basically get an I131 which has all your immi information on it. It also includes your photo and validity period. There is also an area for stamping it when you re-enter the country. I hope this helps.

To send the inquiry thru your congressmen and Senators, you need your A numbers and SSNs too, along with your country of origin, DOB, profession, employer and all nine yards. This is a official faxed or mailed request which shd have date, sign and marked to your congressmen's office. Part of Federal privacy rule.

Saimrathi, you are posting the same message on all threads. Anyway, I am sure some of the media will pick up the story and write about it. I think there are benefits from this campaign. The name Immigration Voice is out there. We may get more members of our community to join us and participate in future campaigns and we can learn from experience on how to carry out future campaigns, protests etc. We had to speak out in some way on what happened to us with the USCIS Visa Bulletin fiasco. I believe it was worth it for all these reasons.
Sorry to jump again and pose another Q here. I have seen this happening more than once from saim*. He/She posts the same thing across three threads and whats the point of the boxes being opened by Mr Gonzalez or being received by him intact. You must be trying to play spoil sport here or just acting childish. Can you send me a PM with your number and I would like to talk with you and help you understand what we were trying to accomplish here?

It seems more and more cases are getting pre-adjudicated. This is something we all knew but its good to see its pace in a nice little chart. I like these new USCIS site improvements
USCIS: National Processing Volumes and Trends (http://dashboard.uscis.gov/index.cfm?formtype=9&office=4&charttype=1)
Hey there is not change for immigration yet...but i think things are certainly much better than a year ago...maybe it will be a little better next year...atleast its not getting worse :)

Every 485 applicant needs to submit birth certificate. If in regional language then get it translated in english. I dont know any place/person for translation, but you would need to submit english version.
Do we need the Birth Certificate for secondary applicants(spouse).
None of the checklist(Employer based I-485) I have been thru say that I need the secondary applicants Birth certificate.
My spouses Birth certificate is in a regional language, and hence the question.
Moved this to the Birth Certificate thread.....

also very recently a new bill has been drafted. but i don't have more info. A gist of it is:
Republican Senate candidate David Kramer on Monday proposed an immigration reform plan that opens the door to legal status for illegal workers who have been in the United States for five years or more.
For more details look at the below url

Most of the time it was voice mail.
Person from Brad Sherman office mentioned that congressman was supporting the bill.
Person from Robert C. Scott office mentioned that she did know the position but the congressman has supported these kinds of bills in the past.
Thanks aadimanav. Other please call.

I guess Mr. Sunshine will be out then, he said he is shit scared that he is going to loose his job...Dude, I say go home, NOW, aren't you ashamed about your sorry job....
I strongly disagree with you. No one has right to say to anyone else to go home.
We may not agree with SunnySurya for this lawsuit, but we should keep debate civilized. No personal attacks please.

I don't think it is unfair as I think
That if eb2 numbers are not filled then they automatically get allocated to eb3 so why to have portability to eb2.

I have a couple of very urgent questions that I want to check with you folks:
I am currently in the US on L1 Individual visa - my current visa is expiring on the 10th of March. My employer filed for a fresh L1 Blanket Visa instead of doing an extension because I have to be in India for a few days in March anyway. My visa interview is on the 11th of March.
My first question is: Is this alright? Am I going to have any problems because I did not extend my visa and applied for a fresh one instead? I have just been in the US for 5 months in my current visa.
Second question is related to PIMS:
I have had 3 L1 visas till date - first one was stamped in 2003. Second in 2005 and my current one in 2006. I have never overstayed and I was out of the US for 13 months before I came on my current visa in Oct 2007.
Will I face any delays due to PIMS when I go for stamping on Mar 11? I plan to be back and rejoin work on the 18th of March.
Is PIMS delaying folks only in case of L1/H1 extensions? Looking forward to your help and guidance. Thanks a lot.

How about, they are expecting so many application 140 plus 485...that THEY DO NOT WANT TO PROCESS ANY APPLICATION...like always - THEY WILL SIT and EAT BURGERS and dont WANT TO DO ANY WORK...nothing new here folks...
On Monday I upgraded my I-140 at NSC to Premium Processing category. It got approved in just 3 days. It is not as if they are not doing any work. In fact I checked that the TSC I-140 dates (my successor in interest I-140 is pending here) have moved forward too.
I think they stopped premium processing I-140's now as they know there will be a flurry of AOS apps, which they would want to look at.
For the same reason, I think the AILA thing about a new interim bulletin is also a rumour.
Given a chance though, I would want to file ASAP... who won't?

The fact is there aren't enough quality resources to be picked from GC/Citizen pool. That is the reason companies are willing to deal with complex immigration laws for hiring a non-immigrant worker....
I agree with you. If the employee is good, most companies (my workplace included) sponsor H-1B visa to get the resource. However, in the current market environment, the available supply of resources outnumbers the job demand.
So many people on H-1B/EAD/GC are looking for job. On the other hand, companies are under tremendous pressure to reduce the cost. Its common to see forced unpaid leave (furlough) for employees.
The current recession is far worse than 2001-2002 recession, in my opinion.

All,
Received CPO mail today for self, wife but then after 30 mins the status changed to 'deceison' .
Does this mean I am greened?
EB2 - India PD DEC 22 2005. NSC
I-485 receipt date: Aug 21 2007.
Opened SR on 08/11/2010
Yes, you are. The decision status happens when your wlecome notice gets mailed out. You will get that either today and within next couple of days. Mine also got changed like that, but only after 6 days.
Interesting part is even after I got my GREEN CARD to my hand, it is still saying the status as DECISION.
